1. Introduction Welcome to LT Tours! These terms and conditions govern the provision of our 3D virtual tour services. By using our services, you agree to abide by these terms. Please read them carefully before proceeding.
2. Definitions
"We," "Us," or "LT Tours" refers to the provider of the 3D virtual tour services.
"You" refers to the user or customer of our services.
3. Scope of Services
LT Tours specializes in capturing both indoor spaces and vehicles using 3D cameras through Matterport software. Please note that our 3D camera technology is primarily suited for indoor use, except for drone captures. For outdoor captures using a drone, the environment must be suitable (e.g., not too windy) for accurate results.
Our services include creating, hosting, and providing access to virtual tours of properties and vehicles using Matterport technology, along with additional services such as virtual staging and drone footage.
Please be aware that the space is captured exactly as it is during the scan. If the environment is dirty or unclean at the time of capture, it will be reflected accurately in the virtual tour.
Virtual tours and models cannot be downloaded and can only be viewed online. Photos and media provided can be downloaded.
4. User Responsibilities
You are responsible for providing accurate information and granting exclusive, uninterrupted access to spaces for capture.
Ensure spaces are suitable for Matterport capture and obtain necessary permissions for us to access and capture the spaces.
5. Intellectual Property
LT Tours retains ownership of all intellectual property rights associated with the virtual tours.
You are granted a limited license to use the virtual tours for personal or business use only.
6. Payment Terms
Deposit and Final Payment: A 20% deposit is required before the scheduled booking time. The remaining balance is due upon completion of the service.
Hosting Fee: We provide a period of free hosting that is included with every virtual tour. After this period, additional hosting is available at $80 per year. If the free hosting period ends and no additional hosting payment has been made, the space will be archived, and a $40 fee will apply to unarchive with 4 months access.
7. Confidentiality
Any information provided by you for virtual tour creation will be kept confidential.
8. Limitation of Liability
To the extent permitted by law, LT Tours shall not be held liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services, including but not limited to lost profits, data loss, or business interruption.
Our total liability for any claims arising from or related to these terms and conditions or our services shall not exceed the total amount paid by you for the services.
9. Governing Law and Dispute Resolution
These terms and conditions are governed by the laws of Victoria, Australia.
Any disputes arising from or in connection with these terms and conditions shall be exclusively subject to the jurisdiction of the courts of Victoria, Australia.
10. Changes to Terms and Conditions
LT Tours reserves the right to update these terms and conditions without prior notice. You should review these terms periodically for any changes. Continued use of our services constitutes acceptance of the updated terms.
11. Cancellation and Rescheduling
Rescheduling requests made more than 24 hours before the original booking date may not incur a fee. Requests made within 24 hours of the original date may be subject to a fee.
In the event of a no-show or failure to grant access as scheduled, a 100% cancellation fee will apply.
